Rosen, Buffalo, and Josephine Mancuso, Buf- $87,737 IS RULED DUE CREDITORS OF SEAWAY CONCERN Creditors of the bankrupt Dutcher Queenstown, are entitled to $87,737.35 resulting from work done for the Corps of Engineers on the St. Lawrence Seaway. Bankruptcy Referee James R. Privitera in a. 21-page opinion rejected the claim of the Reliance Insurance Philadelphia, that it was entitled to the money since it paid Dutcher's bills after the construction company went bankrupt in 1956 and was unable to finish excavation of the Bertrand H.

Snell Lock. The insurance company paid $326,248.42 in Dutcher's bills and said as a result that it was entitled to the money retained by the engineers in the Dutcher account pending completion of the work. Other companies finished the job and were paid $40,000 from $127,737.35 held by the Engineers. Mr. Privitera said that when the bonding company paid Dutcher's bills it was "merely extinguishing the risk" it undertook when it provided the bond.

He said its claims against Dutcher do not hold priority but are equal to those of other creditors..
